These Terms of Service (‘Terms’) govern your use of our website located at aromaarmour.com (‘Website’).

The Terms also apply when you purchase products from us through the Website or in-person (‘Products’).

By accessing/using our Website or purchasing our products, you agree to be bound by these Terms. If you do not agree with any part of the Terms, do not continue using this Website or purchase any Products.

By using our Website, you represent and warrant that you are of sufficient age to enter into a contract with us or that you are of sufficient age to enter into a contract with us and you have given us your express consent to allow any of your minor dependents to use the Website.

You may be required to sign-up and register an account when purchasing Products from the Website (‘Account’). You will be required to provide personal information to establish your Account. The personal information we collect will help us manage orders and to create a better experience for you. Our Privacy Policy details all the personal information we may collect in full.

You will be responsible for maintaining the accessibility of your Account. You agree to accept responsibility for all activities that occur from your Account. By creating an account, you warrant that the information you have provided is complete and accurate. We reserve the right to disable your Account at any time.

By using our Website, you agree not to: violate any applicable laws or regulations, infringe upon the rights of others, access or use the Website in a detrimental way to the Website, attempt to gain unauthorised access to any part of the Website, or engage in any conduct that restricts or inhibits any party’s use of the Website.

We reserve the right to change the Website in terms of information provided and functionality through an update at any time without notice. You acknowledge that we can't guarantee that: the Website will be free of errors, the Website will always be accessible, and that the information provided will always be accurate or true. We may provide links to external websites of which we do not have or claim responsibility of. 

Intellectual Property

We maintain ownership of the Website and any content posted including text, logos, images, videos, audio, product descriptions, and pricing. You may not use any intellectual property of ours without express written and signed permission from us.

Any content that you create and upload to our Website or send to us with consent that we may use the content will grant us a license to use, reproduce, distribute, display, and otherwise perform all or derivatives of the content on our Website. 

Purchasing Products

By purchasing any Products from us, you are representing and warranting that:

  1. you have legal capacity and are of legal age to enter a contract with us;
  2. you have authorisation to use the payment method you provide;
  3. you have provided us with complete and accurate information.

Shipping will be conducted through a third party and users will be responsible for any incurred shipping costs. Tracking information will be provided for all shipped orders.

We will put forward our best efforts to ensure that product descriptions and pricing on our website are accurate. In the event of discrepancies, we will notify users via email of any price adjustments. Until we have received the full price of the Products you have paid for, we retain the title to those Products. Upon delivery all risk associated with the Products is passed to you. You must not refuse delivery of the Products.

We offer a 30-day money-back guarantee should you not be satisfied with the product. We do ask that you return any unused product to us via registered post so we can re-use, recycle, or safely dispose of the returned Products as appropriate. If you have purchased our Products from the Website and are unhappy with the goods, please contact us at support@aromaarmour.com and we’ll process your full refund to the payment method originally used upon return of the Products. Mobile Communications

The Aroma Armour mobile message service (the "Service") is operated by us. Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Aroma Armour’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Aroma Armour through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Aroma Armour. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Aroma Armour or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Aroma Armour mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

We limit all liability (to the maximum possible extent permitted by law) of all claims by or to you for loss or damage of any kind whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Website and our Products. 

We take no liability for any third party websites that are linked to through our Website, nor guarantee that the information sourced from third party websites is complete and accurate.

All other representations (express or implied) and warranties in relation to the Website or Products provided by us are, to the maximum extent of the law, excluded. 

The Terms do not intend to limit the Australian Consumer Law (ACL) of the Competition and Consumer Act 2010 (Cth).

You indemnify us and all internal (non third-party) operators of all liability for any claim by you arising from your:

  2. breach of any third party intellectual property rights;
  3. breach of any of the Terms outlined;
  4. use of the Products; or
  5. negligent, fraudulent, wilful, or criminal act or omission.

In no circumstance will we be liable (to the maximum extent permitted by law) for any special, incidental, or consequential loss or damages, loss of business, or damages for loss of data arising from connection with our Website, our Products, or these Terms.

These Terms and any other agreements involved in providing the Website or Products to you are govern by and construed in accordance with the laws of Australia.
